Use of Crown copyright images

Use of Crown copyright images from the Defence Image Database and the Royal Navy Photographic Image Database

Where people, organisations or industry wish to re-use images from the websites, the MOD is prepared to licence them on a commercial basis subject to the following conditions:

1. We do not allow the reproduction of images showing clearly identifiable individuals, members of the Royal Family , the dead or wounded, or children . The only exceptions to this are where written permission has been obtained from a clearly identifiable individual or, for a Royal, from the relevant Royal Press Office prior to completing the Directorate of Intellectual Property Rights questionnaire. A copy of the permission should be forwarded with the completed questionnaire.

2. It is not permitted to crop , modify, embellish, amend, deface or reverse Crown copyright images. When an image is licensed we expect it to be reproduced in its entirety. If you wish to create a montage we will only agree to this if it is comprised of all Crown copyright images and each photograph is used in its entirety.

3. Not all images on the Defence Image Database will be Crown copyright. The MOD will only licence those images which it knows to be Crown copyright or can be confirmed as such. Should an image not be Crown copyright any licence request will be refused. We do not provide details as to the identity of the copyright owner of non Crown copyright images. Checks will also be made to ensure the use is not against government policy.

Reproduction fees - We charge for all commercial reproduction. Please be aware that we have standard reproduction fees which apply equally to all requestors including charities.

  • £50.00 for the first two images for a single use
  • £50.00 for each subsequent image/use

We reserve the right to charge a higher rate for some uses, for example

    • £125 for a publication front cover
    • £200 for a book front cover /£100 for a book back cover / £150.00 for a book spine
    • £500 for cards, posters, first day covers

Multiple Use licences

    • A one year licence is £125.00 per image (£100.00 per image if more than six images are granted on a single licence)
    • A three year licence is £225.00 per image (£175.00 per image if more than six images are granted on a single licence)

  • A Royalty arrangement, rather than a one off fee, may be applicable for use in publications. This will only apply where a minimum of seven images are requested. Such an arrangement is subject to a £300 minimum and is based on the following formula:

"retail price of the book x 10% royalty rate x percentage of the book which is Crown Copyright (total number of pages containing Crown Copyright material / total number of pages) x size of the print run"

All fees are subject to VAT at the prevailing rate.

To obtain a licence

  1. Before requesting permission to reproduce an image you should have read conditions 1 - 3 above and checked that the image size is sufficient for the purpose for which you wish to use it.
  2. You should complete and return the Directorate of Intellectual Property Rights questionnaire.
  3. You will be sent a licence, normally by e-mail.
  4. You will be asked to confirm that you accept the conditions of the licence and asked to supply a Purchase Order. An order on company headed notepaper is an acceptable alternative. Where neither is possible you will need to confirm to whom and where the invoice should be sent.
  5. You will be sent, by e-mail, a hi-resolution copy of the image.
  6. A VAT Invoice will then be sent to you by the MOD’s Financial Management Shared Service Centre (FMSSC). Payment should be made direct to the FMSSC preferably by BACS or CHAPS. Neither the FMSSC nor the Directorate of Intellectual Property Rights is able to accept credit/debit card payments.

It should be noted that all licences are granted on a non-exclusive basis and use is strictly confined to that detailed in the licence. Any reproduction of the licensed material not consistent with the conditions of the licence issued will be vigorously pursued and where necessary enforcement action considered.
