Changes to Resettlement and Life Commutation

The Finance Act 2004 has changed the manner in which Life and Resettlement Commutation can be claimed. Please read on for more information:


  • Resettlement and Life Commutation (RC/LC) - Active Service Personnel only

    The Finance Act 2004 contained provisions for the running of tax-privileged schemes. These provisions are the Pension Tax Simplification rules and payments which contravene these provisions are classified as unauthorised payments. If a scheme makes an unauthorised payment, there are significant tax penalties on the individual with a further charge being made on the scheme. These tax penalties can last for the rest of the life of the pension including any dependants benefits awarded. Commutation after Service termination is considered by the Tax Office to be an unauthorised payment.

    One of the Pension Tax Simplification rules requires that a member’s pension may not reduce once it is in payment. If your pension is already in payment, the commutation you are requesting will mean that your pension will reduce. If the MOD were to continue allowing applications for commutation for those who have already left service then any lump sum raised by commutation would not be tax-free and your pension would be taxed at 40% above your normal rate of tax for the remainder of the period it remains in payment. Furthermore, the MOD would seek to pass the tax charge which would normally fall on the scheme on to you, as it is not a fair charge on the tax-payer.

    Therefore, if you wish to commute your pension it is of extreme importance that you ensure that you fill out your AFPS Form 1 correctly, the most recent version can be found in the online version of the Service Leavers Pack.

    If you have already returned your AFPS Form 1 to SPVA and you now wish to apply for commutation, you may reapply, as long as you are currently serving on active service, using the following form

Service Leavers Pack

Welcome to the Service Leaver’s Pack webpage.  Under current arrangements, all Service Leavers will receive a Service Leaver’s Pack from the Termination Cell, SPVA(G), about 9 months prior to their termination date.  This pack is intended to offer guidance and advice prior to and after leaving Regular Service.  If you are eligible for a pack and have not yet received one, you can submit a request through the JPAC Enquiry Centre on 0141 224 3600, Freephone 0800 0853600 or MOD 94560 3600.

The pack contains information about your pension (if eligible), Resettlement, Reserve Liability and Support Agencies.  Any queries regarding the content of a document should be directed to the document sponsor.  SPVA is not responsible for the contents of non-SPVA sponsored documents.

Of particular importance to Service Leavers is the SPVA Pension Form 1.  This form should be completed no earlier than 6 months, and no later than 6 weeks before your last day of service, and must be returned to SPVA (address given on the form).  The completion of this form is a legal requirement and failure to do so will result in a delay of the receipt of Terminal Benefits and pension if eligible.
